Condo assignment back out
I would appreciate it if someone helps me to understand the following aspect of buying a condo on assignment.
I signed a contract to buy a condo in Toronto. All conditions removed and it is only conditional now on the builder's consent.
I found out that the builder gives consent with condition that all incentives including development caps are voided and not applied to the assignee (me).
I am having a second thoughts and thinking about walking from it. Will I get my deposit back?
Because technically builder has not given consent as I have not signed that proposed agreement with changes to the original APS incentives.
Assignment sale contracts clearly state that if no consent received from the builder contract is void and all deposit is returned to the assignee.
