Background Check

I recently accepted a job offer with a private sector company, and I’m now in the process of going through the background check. One of the questions asks, "Have you ever been convicted of a felony or misdemeanor for which the record has not been sealed or expunged?"

Two weeks ago, I had a criminal record clearance hearing for a “wet reckless” charge, and my lawyer represented me during the process. I received an email afterward congratulating me, saying that all charges were dismissed and that my record was expunged. They also mentioned I would receive an official court order within the next 30 days.

Based on my research, it seems I can now answer "no" to the question, since the record has been expunged. However, I did get an automated email from the company generally outlining how to fill out the background check form. They specifically stated that I needed to be accurate on my employment dates name of company I worked for ect. and that I need to disclose any prior criminal convictions, including misdemeanor traffic offenses like DUI or reckless driving, and mentioned that even minor violations, such as speeding or moving violations (which are classified as misdemeanors in Georgia), need to be listed. They also warned that failing to disclose any conviction could result in the offer being rescinded.

For context, I was convicted of a wet reckless in California completed the 1 year probation and now have it expunged and "dismissed" which from my understanding this there is no longer a conviction. Also, this is not a driving related role and they have not asked for my Drivers license or anything. This is a standard office job based out of another State.

I’m looking for some feedback from others who might have dealt with a similar situation. Or just overall thoughts on how to approach answering the question. Appreciate any thoughts!
