Landlord Trying to Scam my Deposit

Hello!

I have been staying at this apartment since 2020, I had a contract under my fathers name in the beginning because I did not have the correct documents yet to have it in my name, the landlord knew about it and didn't have an issue with me living there while under my fathers name. There I paid a 2 month deposit. 3 years later I decided to change it to my name just to have it in my name, no specific reason. The contract got renewed and I had no problem with it. The landlord has been extremely good to me so I didn't really look it over too much which was my first mistake. The new contract didn't say anything about the 2 month deposit. Now I want to move out and I ask him a question if I paid 2 months deposit or one because I couldn't remember. He then tells me that since the new contract says nothing about deposits, I'm not getting anything back. I then call my lawyer, and he tells me that since my dad never got the deposit back when it was under his name, that should be returned. The new contract doesn't matter since the deposit was never given back when the first one got cancelled. I call the landlord back and he immediately changed his tone, from being condescending saying I won't get anything back to suddenly saying he is currently very busy with work and that once he sees the place and checks it out, that then we can talk about it.

I have a feeling he is definitely going to look for stuff to charge me and not give the full deposit. The only damages in the house are normal wear and tear. Some smudges on the walls, drilled holes from mounting a TV and some other stuff which he said were completely fine when I asked him about it. And a very small dent on a wall when I tried to move a couch. Let's say that he will charge me for all this, technically since it is a new contract, doesn't that mean that all the damages he sees now are out of my pocket and not from the deposit of the previous contract. Because legally my father should have gotten back that deposit

I am going to speak more with my lawyer but if anyone has any tips or suggestions please let me know! Thank you
